Defendant was found guilty of Murder in the Second Degree and sentenced in 1994 to an indeterminate term of imprisonment of 25 years to life. Defendant made two motions to vacate his judgment of conviction which were denied, on August 12, 1995 and March 1, 1999, respectively. The Appellate Division, Second Department, affirmed the judgment (242 AD2d 745 [2d Dept 1997]), and the Court of Appeals denied defendants application to appeal (91 NY2d 896 [1998]).
