In 1986, the trial court*fn1 sentenced Frank Rodriguez to death for his participation in the kidnapping, robbery, rape, and murder of Lorraine Martelli. We affirmed the imposition of the death sentence, People v. Rodriguez, 794 P.2d 965 (Colo. 1990) (Rodriguez IV), and the United States Supreme Court denied certiorari. Rodriguez v. Colorado, 498 U.S. 1055, 112 L. Ed. 2d 789, 111 S. Ct. 770 (1991). Pursuant to Crim. P. 35, Rodriguez sought postconviction review of his death sentence. The district court granted relief in part, denied relief in part, and refused to vacate the death sentence. Both Rodriguez and the prosecution appealed. We affirm in part, reverse in part, and remand in part with directions.
