Luis Valenzuela Rodriguez appeals from a judgment of death imposed for the first degree murders of California Highway Patrol Officers William H. Freeman and Roy Paul Blecher on December 22, 1978. The jury found that appellant had personally used a firearm in both murders (Pen. Code, § 12022.5)*fn1 and, as special circumstances justifying the death penalty, that he was convicted of more than one murder (§ 190.2, subd. (a)(3)) and that both victims were peace officers intentionally killed while in the performance of their duties (§ 190.2, subd. (a)(7)). The crimes were committed in Yolo County, but pursuant to appellant's motion for change of venue, the case was transferred to San Mateo County for trial.
